• ‘Working day’ means any day other than a Saturday, Sunday, and a bank holiday in England and Wales.

2. You must ensure your details provided on registration are correct.
3. You must inform us immediately of any changes to your details by updating your personal details.

Password and Security

When you register to use the site, you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password, you should notify us by contacting Customer Services.

If we have reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account in accordance with the T&C.

• The images of the products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, your products may vary  from those images.
• The packaging of the products may vary from that shown on images on our site.

Pricing and VAT

• All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the delivery charge which will be charged at the rate specified when you place your order.
• Please note, the prices on our website and app are guide prices only and subject to change at any time.
• The actual price you pay will be the price charged at the time your order is picked for delivery. The actual order value cannot be determined until the time of delivery because the prices and product weights stated on the website may vary either above or below the prices/weights applicable when your order is picked and delivered.
• When your order is delivered, you may then return any item and receive a full refund if you are unhappy with the price charged (excludes Fresh, Frozen & Perishable items). However, we will endeavour to meet price/weight expectations according to the order.

Payment

• We do not accept payment by cash or cheque. We only accept the following secure payment methods: Visa, Mastercard, American Express, Maestro, Delta and Switch. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure.
• Authority for payment must be given at the time of placing your order. In order to help us validate your payment card, a card check will be performed automatically at check out. At the time of finalising your order for dispatch, full authorisation takes place whereby the total amount will be requested from your bank.
• Please ensure that the expiry date of your payment card is after the anticipated dispatch date of your order. Payment is taken at the point of dispatch for goods and in the event that the payment card has expired, we will be unable to take payment and fulfil your order.
• We reserve the right to cancel your order if payment is not received or received on time.

Delivery

Goods shall be delivered to the shipping address specified by you on the completed order form. For full details please see our Delivery Information page.

Changing or Cancelling Your Order

You CAN NOT make changes to any of your current orders once your order has been placed.

You can cancel your current order up until the order cut-off point specified. Please call our customer service on  [phone no] to cancel the order. Please note that orders cannot be cancelled by email. 

Returns and Refunds

We’d like you to be happy with everything you order from deshibazar.co.uk. Unfortunately, your order or individual products cannot be returned to the driver at the point of delivery. If you are unhappy with any of the products, please email us at deshibazar.co.uk@gmail.com.

Our refund policy is in addition to and does not affect any of your legal rights. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. If goods are not fit for consumption on receipt of delivery, please contact us immediately. You must not consume a product that you believe is not fit for consumption. If you have any doubts, do not attempt to consume the product and contact us immediately. We will endeavour to reply quickly but if the reply is delayed – do not consume the product.

If there are any issues with your order, including missing items, please email us immediately within 24 hours of delivery at deshibazar.co.uk@gmail.com. Refunds will not be issued for missing items not reported within 24 hours. Any returns or exchanges can only be accepted if they are authorised by us.

Under conditions set out at Returns & Refund policy you may remain responsible for the delivery charge and this will be deducted from your payment before payment is refunded to you. We reserve the right to refuse any return and/or exchange due to any reasonable and/or unethical reason.

In the event of a refund, the customer should return the item in its original packaging and is also liable for the cost of return. The customer also has the legal obligation to take reasonable care of the products while they are in their possession. Customers should allow up to 14 working days to fully process their refund, this will exclude the original shipping cost. Where applicable, refunds will be made to you using the same method and to the same account as used by you to pay for your order.

Product Availability and Alternative Product Policy

If for any cause beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. When an item you have ordered is unavailable, we will attempt to deliver a suitable substitute, unless you have asked us not to. If no alternative is found, you will not be charged for the item. If you do not want to receive an alternative product, please leave a message in “Order Notes” which can be found on the checkout page; usually found at the checkout page.

Complaints Procedure

At all times we will try to provide you with good service. In the event you are dissatisfied with any part of our service or product, please put your complaints by email. We will update you with our findings and let you know the action we propose to take in assisting your complaint.

If you would like to escalate your complaint, you can take the matter to Alternative Dispute Resolution (ADR). Although we do not participate in an ADR scheme, one such scheme is provided by Consumer Arbitration. More information on ADR can be found on the Trading Standards website.

Discount and Coupons

In addition to the following, please also refer to your coupon as individual terms and conditions may apply.

• Unless otherwise stated, coupons can only be redeemed online at deshibazar.co.uk and only one coupon valid per transaction after promotions are applied.
• Coupons are only valid on orders placed and delivered by the specified expiry date.
• Coupons have no cash redemption value, are not to be transferred, bought, sold, or in any way traded or published.

Liability

Your order is an offer to buy from দেশী Bazar. A contract is only formed when we have dispatched your order. Up until the point of dispatch, we may decline the goods to you.

If the goods we deliver are not what you ordered, are damaged or defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email or telephone of the problem within 24 hours of the delivery of the goods in question.

If you notify a problem to us under this condition, subject to the conditions above, our only obligation will be, at your option:

1. To make good any shortage or non-delivery;
2. To replace or repair any goods that are damaged or defective; or
3. To refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage, or expenses (including loss of profits, business, or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the terms and conditions above.

Once goods have been delivered to the shipping address, we are not liable for your goods. This means that you shall be responsible for all loss or damage or deterioration of the goods. It is then the customer’s responsibility to store these goods appropriately, as we will ensure the order reaches you in perfect condition.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Due to the nature of the internet, we cannot guarantee the use of our website will be uninterrupted and transmission error-free. However, we will ensure our website is functioning to prioritise easy use for all our customers. We will keep website repairs and maintenance to a minimum, so occasional restriction of access may be expected.

The exact minimum and maximum weight of artisan products cannot be guaranteed. We are not liable for under or over-weight products. However, we will endeavour to meet weight expectations.

Events Beyond Our Control

We shall have no liability for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, or accident.

Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

Third-Party Rights

A person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement, but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
